About licenses and third party content

Below are the guidelines for using our site, which we endeavor to maintain for seamless operation (1.1). This grants us the authority to discontinue access to our site and services if necessary (1.2).

You are prohibited from utilizing our intellectual property (1.3), but you are welcome to share your own content on findmyXpert. You bear responsibility for the content you post (1.4), and we are not liable for content posted by other users (1.5). Should you suspect copyright infringement, please inform us promptly (1.6).

1.1 We let you use our site and services

In essence, we are granting you a "limited license" to access the site. This means that you are permitted to utilize our website and services (referred to as the services). You have this access (or limited license) on the condition that you adhere to these terms of use and all other applicable Terms of Service.

While we strive to ensure the safety and functionality of our services, we cannot guarantee uninterrupted access. It is possible that we may cease providing certain features or services altogether, and we are not obligated to provide prior notice in such cases.

1.2 We can stop letting you use our services

We reserve the right to revoke your access to our services at any time. Should you breach our Terms of Use or other sections of our Terms of Service, we may revoke your access to findmyXpert. Formally, this is referred to as terminating your license. In the event of such action, we will notify you, and you are required to cease using our services immediately.

1.3 We keep the rights to our intellectual property

While utilizing our services, you are not granted permission to utilize any of our trademarks or other intellectual property, such as copyrights and patents. We retain all rights to our intellectual property, despite granting you access to our services.

Our logos and names constitute our trademarks and are registered in specific jurisdictions. Any other product or company names, logos, or similar symbols visible on FindmyXpert may be trademarked by our partners or other users like yourself.

1.4 You can use findmyXpert to share your content with the world

1.4.1 You’re responsible for what you post

You are accountable for your conduct on our site and for any content you publish. If someone lodges a claim against us because of your content, you consent to reimbursing us for our legal expenses and costs (legally termed as ‘indemnification’).

By posting content on our site or providing us with content for posting, you affirm that you bear full responsibility for that content, and we are not liable. You also agree to only post or provide content that:

  •  You have the legal right to post.
  • Is lawful.
  • Does not infringe upon anyone’s rights, including intellectual property rights.

You acknowledge and accept that the individual posting content is liable for any harm caused by that content – not FindmyXpert. Furthermore, you agree to indemnify and defend us, our partners, employees, and representatives against any expenses, legal actions, or governmental proceedings resulting from your content.

1.4.2 Other people have some rights to what you post

When you post content on the site, you grant certain rights to that content to others. When you post content on our site, you grant us and our affiliates a perpetual right (known as an ‘irrevocable and non-exclusive worldwide license’) to utilize, modify, and distribute that content – globally and without remunerating royalties. If your name, voice, or image is included in the content you post, we may also utilize them on the site or in our regular business operations. For instance, if you’re a freelancer, we may share your profile with clients we believe could be a suitable match.

Additionally, you grant each user and site visitor the right to access and use your content through the site. They also have the right to utilize, reproduce, and distribute your content – provided they do so through the site and adhere to both our Terms of Service and applicable laws.

We may display advertisements near your content and information, without providing compensation to you. Depending on the preferences you set in your profile, we may also feature your name or photo when promoting one of our features.

1.4.3 We’re open to your ideas

We eagerly welcome your feedback on enhancing FindmyXpert. Here’s what occurs when you share your thoughts with us: You’re invited to provide comments and suggestions regarding our services and potential improvements. By doing so, you acknowledge that your ideas are voluntary and provided without expectation of compensation, unless we’ve explicitly requested your input and offered something in return (we value our commitments). You agree that we have the liberty to utilize, modify, and distribute your idea as we see fit, without any obligation to compensate you.

Moreover, you acknowledge that our use of your idea does not preclude us from utilizing similar or related concepts, including those already in our possession or obtained from other sources.

1.5 Third parties post on findmyXpert, too

Individuals who utilize our platform are accountable for the content they post or link on FindmyXpert. We do not assume responsibility for the accuracy or reliability of any content shared by users on our site, unless they are officially affiliated with us when they share or post the content. The views expressed in any content belong to the individuals sharing it, not FindmyXpert.

Additionally, our site may feature links or provide access to third-party websites and applications. These external sites and applications are owned and operated by entities other than FindmyXpert. The inclusion of a link or application to a third-party website does not constitute an endorsement by us. By accessing these third-party resources, you acknowledge that you do so without our endorsement.

1.6 You can make a copyright complaint

If you believe that content on our site violates your rights, you have the option to request its removal. Upholding UAE. copyright and associated laws is a priority for us, and we expect both site visitors and users to adhere to these regulations. Therefore, you cannot utilize our site to store or distribute material that infringes upon anyone’s intellectual property rights, including those protected under UAE copyright law.

If you are the owner of copyrighted material and suspect that your rights have been violated by content on our site, you have recourse under the Digital Millennium Copyright Act (DMCA). You can submit a request for the removal of infringing content through the procedures outlined by the DMCA.

2 What you’re not allowed to do on findmyXpert

Our services are designed for professional use, primarily for conducting work-related activities and gaining insights from the information provided.

Our platform is tailored for business purposes, fostering connections between users, facilitating collaborative endeavors, and facilitating payment transactions for services rendered.

Additionally, certain services offer informative content, such as our FindmyXpert blog, aimed at providing valuable resources to our site visitors and users. While we strive to ensure the accuracy and timeliness of this content, occasional errors may occur. Therefore, we do not guarantee the accuracy of information posted on our site, and it should not be relied upon as tax or legal advice. It is advisable to independently verify the information provided for accuracy.

2.1 Posting unacceptable content

You are prohibited from engaging in the following activities on our platform:

  • Posting or promoting content that is illegal or defamatory
  • Sharing content that is violent, discriminatory, or harassing, whether directed generally or towards specific individuals or groups, including those belonging to legally protected categories
  • Sharing sexually explicit content or content related to sex work or escort services
  • Engaging in any activity related to child exploitation
  • Infringing on intellectual property rights, including copyrights
  • Violating our Terms of Service, the terms of service of other websites, or any similar contractual agreements
  • Acting contrary to professional or academic standards or policies, such as submitting someone else’s work as your own or ghostwriting essays, tests, or certifications
  • Participating in the purchase or solicitation of fake reviews or engaging in the creation or dissemination of misleading content, such as deep fakes or fake news, intended to deceive others.

2.2 Acting in a misleading or fraudulent way

On findmyXpert, any form of dishonesty or deception is strictly prohibited.

You are not allowed to misrepresent yourself, your skills, experience, or professional qualifications, or those of others. This includes:

  • Providing false information about your skills, experience, or professional qualifications
  • Using generative AI or other tools to artificially enhance your job proposals or work product, especially if such use is restricted by your client or violates any third-party rights
  • Claiming ownership of someone else’s profile or identity
  • Using a profile picture that does not accurately represent you or misleads others about your identity
  • Impersonating or falsely attributing statements to any individual or entity, including findmyXpert representatives or forum leaders
  • Falsely claiming or implying connections to persons or organizations, such as falsely stating employment with a specific company, or agencies utilizing a freelancer’s profile after terminating their collaboration.

Similarly, you must always be transparent about who is performing the work. This means you cannot:

  • Permitting someone else to use your account, which deceives other users
  • Falsely representing that one freelancer will complete a job when another will actually do so, including submitting proposals on behalf of a freelancer unwilling or unable to perform the work.

We are committed to preventing fraud and misrepresentation, especially concerning payments. Therefore:

Freelancers are prohibited from fraudulent billing practices, including:

  • Altering recorded hours, keystrokes, or clicks in the findmyXpert app
  • Billing for time not actually worked
  • Claiming credit for work performed by another individual
  • Soliciting bribes or other payments without providing services in exchange.

Clients are also prohibited from engaging in payment-related fraud, such as:

  • Posting jobs with payment terms that are objectively unreasonable or disproportionate to the requested services’ scope
  • Requesting services without intending to provide or failing to provide payment in exchange for the services.

2.3 Treating others unfairly

At findmyXpert, everyone must adhere to fair and lawful treatment.

You are prohibited from using findmyXpert to:

  • Express unlawful preferences in job postings or proposals
  • Unlawfully discriminate against individuals
  • Incite or encourage violence
  • Share personal identifying information or other sensitive, private data about others
  • Spam users with proposals or invites, including posting duplicate job listings simultaneously and contacting connections outside of findmyXpert without their consent
  • Solicit or demand bribes or payments for anything other than legitimate work
  • Request or demand free work, such as asking freelancers to provide services for little or no payment as part of a proposal bid or competition
  • Require a fee to submit a proposal
  • Offer or provide services primarily related to making purchases on behalf of others, including the acquisition of cryptocurrency or NFTs.

2.4 Abusing our feedback system

It’s imperative to utilize our feedback system with honesty and fairness.

This entails refraining from:

  • Delaying payment or work until receiving positive feedback
  • Exchanging payment (or any valuable item) for feedback, even with third parties
  • Coercing another user by threatening negative feedback
  • Using the system to express unrelated views (such as politics or religion)
  • Offering or accepting fake services to enhance your feedback or rating score, known as feedback building.

2.5 Other uses that aren’t allowed

findmyXpert relies on technology and trust, and here’s how we uphold these principles:

  • You are prohibited from copying, sharing, or transferring your account. Having multiple accounts or selling, trading, or giving your account to others without our permission is not permitted.
  • You are not allowed to circumvent our platform. Specifically, you cannot communicate with other users or share contact information outside of findmyXpert before agreeing to a service contract. This includes adding contact details to job posts, profiles, or communications. (Exceptions may apply for Enterprise clients.)
  • Promoting other organizations, including advertising external websites, products, or services, is prohibited. Additionally, you cannot recruit freelancers or clients to join other agencies, websites, or companies through our platform without paying a fee. Refer to Section 7 of our User Agreement for more details.
  • Interfering with our technology or tampering with our site or services is strictly prohibited.
    This includes:

  – Attempting to bypass security features implemented to restrict site usage

  – Disrupting or compromising our systems, server security, or transmissions

  – Using automated tools like robots, spiders, or scrapers without written permission

  – Unauthorized copying, distribution, or use of information found on findmyXpert

  – Collecting or utilizing identifiable information, including account names

  – Overloading the site with excessive information

  – Introducing malware or other harmful code

  – Accessing our services through unauthorized technology

  – Framing or linking to our services without written permission

  – Developing a similar service, identifying or poaching our users, or publishing performance or benchmark analyses without permission

  – Reverse engineering, deciphering, modifying, or extracting source code without permission, unless it is open source.

3 Enforcing our terms of use

If any of these rules are violated, we reserve the right to suspend your account and restrict your access to findmyXpert (4.1). If you observe another user violating these rules, we encourage you to report it to us (4.2).

3.1 We enforce these rules
We reserve the authority to investigate any potential violations of these terms of use and may opt to temporarily suspend, modify, or remove any content from our site during such investigations.

While we cannot assure action will be taken against every potential violation, our failure to address one breach does not waive our right to address any subsequent breaches, regardless of their relation to the initial breach.

Should we suspect misconduct, we retain the right to terminate your access to our site at any time. In the event of an account disablement or closure, you will lose access to our services, yet certain provisions will persist:

  •  Our entitlement to utilize and distribute your feedback
  •  The rights of our users and visitors to share your content (as detailed in section 1.4.2)
  • Your agreement to abide by all rules outlined in section 3 of this document.

3.2 Tell us if you see someone breaking these rules
If you suspect any violation of our Terms of Use, please inform our customer service team or report it using the designated flag icon wherever available.

Should we proceed with investigating the breach, you agree to cooperate with our inquiries and undertake reasonable measures to assist in resolving the issue.

4 Definitions
Here, we provide definitions for some of the terms used in our Terms of Use. Any additional terms in italics will be defined when they are referenced, either within the User Agreement or Terms of Service.

Affiliate: An affiliate encompasses any individual or entity that is involved in managing, being managed by, or sharing management with us.

Client: A client refers to an individual utilizing our site to procure freelancer services from another user.

Deep Fake: A deep fake denotes a manipulated video or image designed to replace one person’s likeness with another’s in a deceptive manner, without the consent of the person whose image is used.

Freelancer: A freelancer represents an individual or agency leveraging our site to offer their services to clients.

Freelancer Services: Freelancer services pertain to the tasks performed by freelancers on findmyXpert.

Means of Direct Contact: A means of direct contact comprises information that enables direct communication with you or facilitates the retrieval of such information, allowing users to circumvent our site. This may include phone numbers, email and physical addresses, social media accounts, and personal websites featuring contact details.

Site Services: Site services encompass all services, applications, and products accessible through findmyXpert, excluding freelancer services.

Content: Content encompasses user-generated materials posted on FindmyXpert, such as comments, profiles, feedback, images, or other information. It includes any content posted by you, even if elements of it were generated by generative AI or other tools, or in response to queries posed by findmyXpert or other users.
